LS-33 Approval of Compromise of Third Person Cause of Action
The LS-33 form is completed when you enter into a settlement with a third party other than your employer under the Longshore Act. It is extremely important that you obtain an LS-33 signed and agreed to by your employer if you are attempting to settle any type of claims that you may have against third parties and you are going to be receiving any type of settlement funds from third parties other than your Longshore employer. This is an extremely dangerous area of the Longshore Act and it is critical that you consult with an attorney before you accept any funds from a third party or responsible defendant other than your employer.
If you receive settlement funds or monies from a third party and your employer does not agree to such settlement and your employer does not complete an LS-33 form, you will forfeit all of your rights under the Longshore Act against your employer for future compensation and medical benefits.
