Under the LHWCA an employee is actually entitled to receive compensation benefits during periods of incarceration even though, arguably, the employee could not have obtained work due to his incarceration. The case of Allen v. Metropolitan Stevedore Company provided this ruling which is very favorable to injured employees under the LHWCA.
