The LHWCA provides injured employees with only two types of items which they can collect: (1) Medical benefits and (2) compensation benefits. If your claim falls under the LHWCA you will never collect pain and suffering or full lost wages or loss of fringe benefits or anything beyond medical benefits and compensation benefits (as defined by the LHWCA) directly from your employer, unless you can pursue a third party claim or a claim under 905(b) of the LHWCA.
