The reason 905(b) claims are so important is because you can seek full damages through 905(b) claims. Under the compensation and medical sections of the LHWCA you are limited to only medical benefits and compensation benefits. In contrast, you can seek pain and suffering, full lost past and future wages, full lost fringe benefits and any other damages they have suffered under 905(b) claims. However, remember that in order to collect under a 905(b) claim you must prove that the defendant was negligent in causing or contributing to your injury. And you will only collect the percentage damages from that company for which the company was negligent.
